Sampler Forge licence agreement
The short version: you may install Sampler Forge on Macs you own or control. It works on your files on your own computer and never uploads them. Anonymous crash reports are sent until you switch them off. Keep backups, because it writes to disk images and to real disks. None of this affects your rights as a consumer.
1. Agreement
This End User Licence Agreement ("Agreement") is between you and Blue Dawn Records Limited, a private limited company registered in England and Wales with company number 17317414 ("we", "us"), for the Sampler Forge software application ("Software"). By installing or using the Software, you agree to this Agreement. If you do not agree, do not use the Software.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on Mac computers you own or control. This is a licence, not a sale; we retain all rights not expressly granted.
3. Restrictions
You may not: (a) redistribute, resell, or sublicense the Software; (b) reverse-engineer, decompile, or disassemble it except to the extent that restriction is prohibited by law; or (c) remove or alter any proprietary notices.
4. Your content
The Software processes your audio samples and disk images locally on your device. You retain all rights to your content. We claim no ownership of, and do not access, upload, or store, the files you work with. See section 6.
5. "Akai", "S1000", "S1100"
"Akai", "S1000", and "S1100" are used solely to describe the file and disk formats the Software reads and writes for interoperability. The Software is not endorsed by or affiliated with the owners of those trademarks.
6. Diagnostics and privacy
The Software includes an opt-out crash and bug reporting feature, on by default, which you can disable at any time in Preferences, Privacy, Automatic crash reporting. When enabled, the Software sends anonymous crash and bug diagnostics to our error-monitoring processor, Sentry (Functional Software, Inc.), to help us fix defects.
We send only diagnostic data, never your audio, disk images, or file contents. Before transmission, home-directory paths are scrubbed to remove your username. You can turn crash reporting off at any time in Preferences, Privacy, Automatic crash reporting. By using the Software with crash reporting enabled, you consent to this processing; you may withdraw consent at any time using the setting above.
7. Warranty disclaimer
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by law we disclaim all implied warranties, including the implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.
We do not warrant that the Software will be uninterrupted or error-free, that defects will be corrected, or that it will be compatible with any particular sampler, disk image, storage device or version of macOS.
You are responsible for backing up your data and disk images before using the Software. The Software writes to disk images and, where you direct it to, to physical media; a disk image or floppy you have not backed up may be altered or overwritten.
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 that this Agreement does not affect.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, LOSS OF PROFIT, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
a. The cap. Our total aggregate liability to you arising out of or in connection with this Agreement and the Software, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the amount you actually paid for the Software in the twelve months before the event giving rise to the claim, or GBP 20, whichever is the greater.
b. Data and media. Without limiting paragraph (a), we are not liable for loss of or damage to samples, disk images, programs, floppy disks, SD cards, or any other data or media, however caused. Sampler Forge writes to disk images and to physical media at your direction, and vintage media is by its nature fragile and often irreplaceable. Keep backups.
c. Hardware. We are not liable for damage to, or loss of use of, any sampler, drive, disk controller or other hardware. Files this Software produces are loaded onto machines we do not control and cannot test in every configuration.
d. Carve-outs. Nothing in this section limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by law as to title and quiet possession, or for any other liability that cannot lawfully be limited or excluded. If you are a consumer, nothing here affects your statutory rights, including your rights in respect of digital content under the Consumer Rights Act 2015.
e. Allocation of risk. You acknowledge that the fee for the Software reflects this allocation of risk, and that we would not license it to you on these terms without it.
9. Termination
This licence ends automatically if you breach it. On termination you must stop using and delete the Software.
10. Governing law
This Agreement is governed by the laws of England and Wales.
